We as POSH consultant, we will ensure the below is followed.

To file a complaint of sexual harassment, it must be done within 3 months of the incident and must include any documentary evidence or names of witnesses, if available. The committee can extend this timeline for an additional 3 months if it is satisfied with the reasons that prevented the complaint from being lodged within the initial 3-month period. The complaint can be made in any form, whether through phone or email, but every oral communication must be followed up with written communication. If a complaint cannot be made in writing, the presiding officer or any member of the committee must assist the person in making the complaint in writing.

If the aggrieved person is unable to file the complaint, any person who has knowledge of the incident, a family member/relative/friend, or co-worker can file the complaint on their behalf. It is the responsibility of the person who receives the complaint to inform the committee members.

The ICC can attempt to settle the matter, but monetary compensation cannot be the basis for settlement. If the aggrieved person is not willing to settle, the ICC will investigate the complaint, and both parties will have a chance to be heard. The inquiry should be completed within 90 days, and if the person who committed the act is found guilty, corrective action will be taken by the appropriate authority. Corrective action can include a formal apology, transfer of the person to another department, suspension or termination of the employee found guilty of such an offense, counseling, and a written warning to the employee, which will be kept on record.

Relief to victims can be in the form of monetary compensation, granting leave for 3 months, or transferring the victim to another department where they feel safe to work.
